Notification of the posting employer

A posting employer who posts his employees to the territory of the Slovak Republic to perform work in the provision of services is, in accordance with Art. § 4 par. 1 of Act no. 351/2015 Coll. obliged to notify the National Labour Inspectorate of the posting of employees.

Posting of employees is a situation when an employer based in a member state of the European Union temporarily sends its employees to work in Slovakia. This process is regulated by European and national legislation to ensure that posted workers have the same working conditions and rights as local workers in the country where they work.

Before you start

To fill out the form you need the following information:

  • data of the employer who sends employees (posting employer),
  • personal data of posted employees,
  • information on performed work and services that the posting employer will provide through posted employees,
  • details of the person authorized to deliver documents (contact person),
  • information on whether the posted employee replaces another psoteded employee.

Ways of notifying the posting of employees

There are several ways in which an employer can notify the posting of employees:

Registration portal

Electronic notification - the posting employer fills in his name and the email contact, registers and creates an account; after registration he will be able to announce the posting of employees and manage the data (indicate a change in the current posted employees or add new posted employees).

Online form

Alternatively, the posting employer can complete the registration form online without the need to register and log in. This form must be filled in, printed and sent to the address of the National Labour Inspectorate, Masarykova 10, 040 01 Košice, or by email to: nip@ip.gov.sk.

Warning

The employer is obliged to keep the employment contract or other document confirming the employment relationship with the posted employees, records of the posted employee's working hours, documents on the salary paid to the posted employee for work performed during the posting at the place of work.

The posting employer is obliged to immediately notify the National Labour Inspectorate of any data changes in paper or electronic form.
